Direct answer
Trademark rights are territorial. A U.S. registration does not automatically register your mark in Canada. Plan protection for each market and assess search results, filing requirements and representation separately.
Choose the market before the filing route
List where you sell or plan to sell the goods or services. Then decide whether a national application or an eligible international route suits the plan. An international application does not guarantee registration in every designated country.
Search each country’s records
A mark can face different conflicts in the United States and Canada. Review relevant national records and potentially related marks; exact-name availability alone is not legal clearance.
Confirm representation and responsibility
Foreign-domiciled applicants must engage a U.S.-licensed attorney for representation before the USPTO. Confirm applicable Canadian representation requirements and who is responsible for the work before purchasing Canadian assistance.
Ask for a country-by-country quote
Request a breakdown of service fees, government fees, classes, currency, search scope and any subsequent work that is excluded.
